Terms and Conditions
Welcome to Capra IT Services. By using our services, you agree to the following terms and conditions:
1. Data Backup Responsibility
- Capra IT Services is not responsible for any loss of data under any circumstances. Customers are strongly advised to back up all data prior to any servicing where possible.
- For data recovery services, we cannot guarantee the recovery of data. Numerous factors can affect the success of data recovery.
2. Data Backup During Clean Installations
- A maximum of 100GB of backed-up data is included in the standard backup fee. Additional data will be charged at $X per 100GB.
3. Virus, Malware, and Infected Files Removal
- While we strive to manually remove viruses, malware, and infected files, complete removal cannot be guaranteed. The only way to ensure the complete removal of such threats is to format the drive and reinstall the operating system.
4. Hardware Liability
- Capra IT Services is not responsible for any damage to hardware during servicing, except in circumstances where gross negligence can be proven.
- The customer shall be liable for any legal fees incurred by Capra IT Services as a result of legal action brought by the customer or a representative against Capra IT Services for damages that are protected by these terms and conditions.
5. Service Limitations and Warranty
- Capra IT Services provides no warranty or guarantee, either express or implied, for the services provided, except as required by law.
- Services are provided on a best-effort basis, and we do not guarantee any specific results or outcomes.
6. Service Fees and Payment
- Payment for services is due upon completion unless other arrangements have been made in advance.
- Unpaid invoices over 30 days will incur a late fee of X% per month.
7. Customer Responsibilities
- Customers must provide accurate information and disclose any known issues with their devices.
- Customers are responsible for ensuring that all software and hardware are properly licensed.
8. Confidentiality and Privacy
- Capra IT Services respects your privacy and will not share your personal information with third parties, except as required by law or as necessary to complete your service.
- We will take reasonable measures to protect your data while it is in our possession.
9. Limitation of Liability
- Capra IT Services' liability for any damages arising from or related to our services is limited to the total fees paid for the specific service.
- We are not liable for any indirect, incidental, special, or consequential damages, including lost profits or data loss.
10. Force Majeure
- Capra IT Services is not liable for any failure or delay in performing services due to circumstances beyond our control, including natural disasters, war, terrorism, or labor disputes.
11. Amendments and Updates
- Capra IT Services reserves the right to amend these terms and conditions at any time. Customers will be notified of any significant changes.
12. Governing Law
- These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which Capra IT Services operates.
